- Administering or monitoring grants, subsidies, licenses, or other federally conferred financial or operational benefits;
- Regulating or auditing any non-federal entity; or,
- Other activities in which the final decision or action will have a direct and substantial economic effect on the interests of any non-federal entity.
In addition, the Department of the Air Force may require confidential filing if it is determined that based on the employee’s duties and responsibilities, filing is required in order for the employee to avoid involvement in a real or apparent conflict of interest.
The Joint Ethics Regulation identifies the individuals in the following covered positions to file an OGE Form 450 unless they are required to file an OGE Form 278e:
Commanding officers, heads and deputy heads, and executive officers of:
- Navy shore installations with 500 or more military personnel and civilian DoD employees (including foreign nationals and indirect hire personnel regularly attached, but excluding personnel attached for temporary duty); and,
- All Army, Marine Corps, Air Force, and Space Force installations, bases, air stations or activities.
Special Government Employees (SGEs), except the following categories of SGEs:
- Physicians, dentists, and allied medical specialists engaged only in providing services to patients;
- Veterinarians providing only veterinary services;
- Lecturers participating only in educational activities;
- Chaplains performing only religious services;
- Individuals in the motion picture or television fields who are utilized only as narrators or actors in DoD productions;
- Reserve Component Members on active duty for less than 30 consecutive days during a calendar year who are not otherwise performing duties impacting the financial interests of NFEs; and,
- Members of selection panels for Reserve Officers’ Training Corps candidates.
Employees who are Presidential appointees confirmed by the Senate, General Officers, or members of the Senior Executive Service are required to file an OGE 278e, Public Financial Disclosure Reports. Please click here for additional information about the OGE 278e filing requirements.
What are the Filing Deadlines and Reporting Periods?
A confidential filer must file a new entrant report within 30 days of assuming the duties of a covered position, unless an extension is granted. The reporting period for a new entrant report is 12 months preceding the filing of the form.
An employee who served in a covered position for more than 60 days during a calendar year must file an annual report by February 15th of the following year. If the 15th falls on a weekend or holiday, the due date is the next workday. An annual report covers the preceding calendar year (January 1 through December 31).
Where are OGE Form 450s Filed?
Per Section 6-100 of the Joint Ethics Regulation, all OGE Form 450s must be submitted electronically using the Financial Disclosure Management (FDM) system. You must have a Common Access Card to use FDM.
